Some of these needs necessitate a dependant visa application. A Dependant visa allows overseas immediate family members of UK visa holders to come to the UK. The Immigration rules refer to PBS Dependant visa and Dependant visa. Both of these allow dependent family members to join the main visa holder in the UK.

PBS Dependant visas simply refer to the ability of those on points-based visas to bring family members to the UK. Please contact us to discuss this further if necessary.

ELIGIBILITY

  • You must be a dependant of a person who is a UK visa holder. A ‘dependant’ refers to a partner/spouse or child of the main visa holder.
  • If you are a partner of the main visa holder, you must prove that you are either married or in a civil partnership with the main visa holder or that you have been living together for 2 years or more.
  • The child applicant must be under 18 years or, if 16 years or older, the child must be dependant on the main visa holder.

Being dependant means the child is:

  • not living an independent life (i.e., not married, in a civil partnership, or have children)
  • living with the main visa holder (unless they attend boarding school or university
  • is financially supported by the main visa holder

Furthermore under the Adult Dependant Relative visa scheme, it is possible to bring elderly members to the UK if the UK resident has indefinite leave to remain (ILR) or UK citizenship.

You must be outside the UK to apply and need long-term care from a parent, grandchild, brother, sister, son or daughter who is living permanently in the UK and:

  • They are a British citizen
  • They have settled in the UK – for example, they have indefinite leave to remain, settled status or proof of permanent residence
  • They have refugee status or humanitarian protection in the UK
  • If your family member has settled status you may also be eligible to apply to the EU Settlement Scheme or for a family permit.
